NOVE25 S.r.l. with registered office in Via R. Sanzio, 19 - 20149 Milano (MI), as the Data Controller protects your personal data, provided by you during the navigation and use of this website ensuring their confidentiality and guaranteeing compliance with the regulations in force as well as the necessary level of protection, from any occurrence that may put them at risk of violation.

As required by art. 13 of the General Data Protection Regulation of the European Union (GDPR), NOVE25 informs you that your personal data, collected through this website, are subject to processing through computer and/or telematic tools, for the purposes indicated below in this statement.

1.OBJECT OF THE PROCESSING

With regard to the data processed by the commercial activity of Nove25 S.r.l.:

The Data Controller processes: 

-personal, identifying data (e.g., first name, last name, company name, address, telephone, e-mail, bank and payment references) hereinafter, "personal data".

- the -particular data‖ communicated by you on the occasion of the conclusion of contracts for the services of the Controller and as the recipient of such data with reference to all communications made and received in the relations with the entities and subjects involved in the professional activity proper of the Controller and the Processor.

With regard to the data processed by the website of Nove25 S.r.l.:

The computer systems and software procedures in charge of the functioning of this website acquire, in the course of their normal operation, some personal data whose transmission is implicit in the;use of Internet communication protocols. Consequently, the following personal data, by way of example, may be processed: 

- browsing data: this category of data includes IP addresses or domain names of computers and terminals used by users, addresses in URI/URL (Uniform Resource Identifier/Locator) notation, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system and the user';s computer environment. Derived data

Information that our servers automatically collect when you access the Site, such as your IP address, browser type, operating system, access times and pages viewed directly before and after accessing the Site.

Financial Data

Financial information, such as payment method information (e.g., valid credit card number, card brand, expiration date) that we may collect when you make purchases, orders, returns, exchanges, or request information about our services from the Site. We store only very little, if any, of the financial information we collect. Otherwise, all financial information is stored by our payment processor, Amazon Payments, Google Checkout, Paypal, Saleforce and Google Cloud Enterprise server and you should review their privacy policy and contact them directly for answers to your questions.

Facebook Permissions

The Site may, by default, access basic Facebook account information, including your name, email, gender, birthday, current city, and profile picture URL, as well as other information you have chosen to make public. We may also request access to other account-related permissions, such as friends, check-ins, and likes, and you can choose to grant or deny us access to each individual permission. Data from social networks

User information may be collected from social networking sites, such as [Apple's Game Center, Facebook, Google+, Instagram, Pinterest, Twitter], including name, social network username, location, gender, date of birth, email address, profile picture, and public contact information, if you link your account to such social networks. 

Mobile device data

Device information, such as mobile device ID, model and manufacturer, and device location information, may be collected if you access the Site from a mobile device.

2. PURPOSE OF PROCESSING

2.1 With regard to the processing purposes of the commercial activity of Nove25 S.r.l.:

Your personal data are processed:

Pursuant to Art 6 EU Regulation No.679/2016 (and subsequent legislative adaptation provisions Legislative Decree 101/2018) (GDPR). lett. b), e) GDPR), for the following Service Purposes:

A)-to conclude contracts for the Controller's services:

-fulfill pre-contractual, contractual and tax obligations arising from existing relationships with you in particular;  

for the realization, production and sale of high quality goldsmithing products;

for inclusion in the master records in the company's computer databases;

For the issuance, invoices and credit notes;

for issuing quotes and quotations to active and/or potential customers;

for the maintenance of ordinary accounting and VAT;

for the management of collections and payments; 

-Personnel selection activities: the Data Controller, in order to initiate personnel selection processes and properly evaluate your candidacy whether aimed at a specific search activity or voluntary, needs to process your Personal Data contained within the Curriculum Vitae and/or requested in the collection form prepared by the Data Controller. 

Legal basis and lawfulness of processing: pre-contractual purpose ex art. 6 letter b) of the Regulations - the Processing of your Personal Data will be conducted by the Data Controller evaluating your application and will be legally based on the pre-contractual relationship that will be created between you and the latter.

-establishment and management of employment or collaboration relationship: the Data Controller, in order to establish and manage an employment or collaboration relationship, needs to collect some of your Personal Data, as required within the employment or collaboration contract. The Processing of your Personal Data will be conducted by the Data Controller and will be legally based on the contractual relationship of employment or collaboration that will be created between you and the latter; 

The legal basis is the contract;

B)-fulfill obligations under the law, a regulation, EU legislation or an order of the Authority (such as anti-money laundering); The legal basis is the legal obligation;

C)-Exercising the rights of the Controller, such as the right to defense in court; the legal basis is the exercise of defense in court;

D)-With Your specific, written, unequivocal and unconditional consent, inform and commercially promote the products of Nove25 S.r.l. themselves; the legal basis for processing is consent;

E) Subject to your specific consent, in writing, unequivocal and unconditional, to carry out a form of automated processing of personal data consisting of the use of such personal data to evaluate certain personal aspects relating to your natural person, in particular to analyze or predict aspects relating solely to the personal preferences, interests, reliability, behavior, location or movements of said natural person for the sole purpose of the personalized realization of the jewelry products of Nove25 S.r.l. themselves; the legal basis of the processing is consent;

2.2 With regard to the purposes of processing the site of Nove25 S.r.l.:

Pursuant to Art 6 EU Regulation n.679/2016 (and subsequent provisions of legislative adaptation D.Lgs 101/2018) (GDPR). lett. b), e) GDPR), for the following Purposes of Service:

The legal basis underlying the processing referred to in (a) of this point is:

- Art. 6(1)(f) GDPR: "processing is necessary for the pursuit of the legitimate interest of the controller or a third party."

3. METHODS OF PROCESSING

The processing of your personal data is carried out by means of the following operations: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, erasure and destruction of data.

The processing will be carried out either by manual and/or computerized and telematic tools with logics of organization and processing strictly related to the purposes themselves and in any case in such a way as to ensure the security, integrity and confidentiality of the data themselves in compliance with the organizational, physical and logical measures provided for in Articles 24 and 25 and 32 of the GDPR. The processing of personal data carried out for the sole purpose referred to in point E paragraph 2 (purpose of processing) of this notice will be carried out in an automated form and also on an online platform and consists of the use of such personal data to assess certain personal aspects relating to your natural person, in particular to analyze or predict aspects concerning only the personal preferences, interests, reliability, behavior, location of said natural person for the sole purpose of the exclusive purpose of the personalized realization of the goldsmith products of Nove25 S.r.l. themselves; the legal basis for processing is consent;

The personal data subject to processing are collected directly by the Data Controller or by third parties expressly authorized by the latter, or communicated by the Data Controller to such third parties for the pursuit of the purposes referred to in point no. 2.

The processing of personal data will be carried out mainly with the aid of IT tools by persons inside and outside the Data Controller's structure duly authorized and instructed for this purpose according to the methods and with the means suitable to guarantee the security and confidentiality of the data themselves, in accordance with the provisions of the GDPR.

The Data Controller carries out periodic checks so that no personal data are processed, collected,stored or retained that are not necessary in relation to the processing and related purposes as indicated in point no. 2 of this policy.

Regarding applications pertaining to personnel selection, the data processed and the related processing methods are as follows:

Contact information (such as, address, e-mail address, phone number, etc.);

Data on education, professional experience and previous activities;

Special categories of personal data (such as, for example, health status, union membership, etc.) only to the extent that such information is contained in the cv

Processing is carried out in both manual and computerized ways and with the support of paper, computer (management software, accounting, etc.) or otherwise automated and telematic means.

In any case, the processing of data is carried out with the adoption of all appropriate measures to ensure the security and confidentiality of personal data, in particular in compliance with the security measures referred to in Article 32 of European Regulation No. 2016/679 and in accordance with the principles of lawfulness, necessity and proportionality

Policy for Children

We do not knowingly solicit information from children under the age of 13 nor do we market to them. If you become aware of any data we have collected from children under the age of 13, please contact us using the contact information provided below.

Controls for do-not-track functions.

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature or setting that you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard has been finalized for the recognition and implementation of DNT signals. As such, we do not currently respond to browser DNT signals or any other mechanism that automatically communicates your choice not to be tracked online. If an online tracking standard is adopted in the future that we must adhere to, we will inform you of that practice in a revised version of this Privacy Policy. If you set DNT signals on your browser, we will respond to those browser DNT signals.

4. NATURE OF PROVIDING DATA AND CONSEQUENCES OF REFUSAL TO RESPOND

We inform you that, taking into account the purposes of the processing referred to in points A), B) AND C) as illustrated above in point 2.1 , the provision of the data necessary for the purposes is free but their failure, partial or inaccurate provision may have, as a consequence, the impossibility of carrying out the activity and pre-contractual and contractual fulfillments as provided for in the contract of sale and / or supply of products. Where the person giving the data is under the age of 13, such processing is lawful only if and to the extent that, such consent is given or authorized by the holder of parental responsibility for whom the identification data and copies of identification documents are acquired.

5. ACCESS TO DATA BY EMPLOYEES IN CHARGE OF DATA PROCESSING.

Your data may be made accessible for the exclusive purposes set forth in Article 2.A) and 2.B) of this policy:

-to employees and collaborators of the Data Controller, the auxiliaries and third party persons employed companies and supply companies and in outsourcing relationship with the Data Controller in their capacity as persons authorized to process and/or internal data processors and/or system administrators;

-to third party companies or other entities (by way of example credit institutions, consultants, insurance companies for the provision of insurance services, etc.) that perform outsourcing activities on behalf of the Controller in their capacity as external data processors.

6. COMMUNICATION OF DATA

Without the need for an express consent (ex art. 24 lett. a), b), d) Privacy Code and art. 6 lett. b) and c) EU Regulation n.679/2016 (and subsequent provisions of legislative adaptation D.Lgs 101/2018) (GDPR)., the Data Controller may communicate your data for the purposes referred to in art. 2.A) to Supervisory Bodies, Judicial Authorities, insurance companies for the provision of insurance services, as well as to those subjects to whom the communication is mandatory by law for the fulfillment of the said purposes.

 In particular,the recipients of the data may be:

- information and computer support companies;

- companies, or professional firms offering professional and/or consulting services with regard to accounting, legal, tax, administrative, financial, and credit recovery issues;

- providers of IT infrastructure and solutions;

- web service providers;

- banks and payment service providers, acting as Processors, to whom your personal data may be disclosed for the purpose of processing your payments;

- consultants, to the extent necessary for the performance of their professional duties.

The communication concerns the categories of personal data whose transmission to the above-mentioned third parties is necessary for the performance of the activities and for the purposes referred to in this policy.

7.  DATA STORAGE AND TRANSFER

Personal data are stored on servers located in Milan, within the European Union and precisely outside the Data Controller's Head Office and in full compliance with the provisions and requirements necessary for the security and proper location of the data storage units (Data centers).

The aforesaid location and storage arrangements of the data centers may be disclosed only to the data subject whose data is being processed and to the Supervisory Authorities for reasons of national security, public safety, defense in court, for the prevention, detection and prosecution of crimes, for the protection of the interests and freedoms of others, for the execution of civil actions and for relevant objectives of public and economic interest. Whereas, The Controller will process personal data for as long as necessary to fulfill the above purposes and in any case for no longer than 5 years after the termination of the relationship for the Purposes of Billing Service and Corporate Accounting;

Given that The Owner will process the "special" personal data referred to in Art.9 GDPR EU Regulation No.679/2016 for the time necessary to fulfill the above purposes and in any case for no longer than the termination of the relationship for the Pre-contractual Purposes inherent in the phase of mere contractual proposal of entering into a contract of sale of the product; Personal data are retained for the duration of the association and/or mandate relationship and in the case of revocation and/or other termination of the relationship.

Please also note that with regard to the retention of data resulting from the company's sales and marketing activities, the retention period of the data is no longer than 24 months.

8. EXTRA EU/SEAS TRANSFER

The Data Controller does not make any transfer of your personal data abroad (to be understood as abroad all countries not belonging to the European Economic Area).

The management and storage of your personal data will take place on servers of the Data Controller and/or third party companies duly appointed as Data Processors, located within the European Union.

Except for the transfers referred to in the preceding paragraphs, some of your personal data resulting from the use of cookies and other tracking tools are shared with recipients that may be located outside the European Economic Area. NOVE25 ensures that your Personal Data is processed by such recipients in accordance with applicable data protection legislation. Such transfers may be based on an adequacy decision or on standard

9. RIGHTS OF THE DATA SUBJECT

In your capacity as a user You are owner of the following rights: 

-Right to access your data, obtain confirmation of the existence or otherwise of personal data concerning you, even if not yet registered, and their communication in intelligible form; -obtain indication of: (a) the origin of the personal data; (b) the purposes and methods of processing; (c) the logic applied in the case of processing carried out with the aid of electronic instruments; (d) the identification details of the Data Controller, the data processors and the representative of the Data Controller and the persons authorized to process the data; and (e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of the data in their capacity as designated representative in the territory of the State, data processors or persons authorized to process the data; (Art. 15 GDPR).

-Right to update, rectification or, when interested, integration of data; (art. 16 GDPR).

-Right to erasure, transformation into anonymous form or blocking of data processed in violation of the law, including data whose storage is not necessary in relation to the purposes for which the data were collected or subsequently processed ; (art. 17 GDPR).

-Right to request the restriction of use of data for the sole reasons of public interest and for the establishment or defense of a right, in cases where the data subject disputes the accuracy of the data and processing, in the case of exercising the right to object to processing under Article 21 GDPR, and in the other cases provided for in Article 18 GDPR ; (art.18 GDPR).

-Right to receive the personal data provided to the Data Controller in a structural format or on a commonly used, intelligible and accessible computer support for any operating system (USB or duly encrypted ZIP file), and to move without constraints, the complexes of information and data concerning you from the presentController to anotherController chosen by you according to your purposes and in full compliance with the principles of transparency, lawfulness and proportionality of the processing.  This right to data portability is without prejudice to other rights; (Art. 20 GDPR).

-Right to object, in whole or in part:

(a) on legitimate grounds to the processing of personal data concerning you, even if relevant to the purpose of collection; (b) to the processing of personal data concerning you for any other purpose not relevant to the processing; (Art. 21 GDPR).

-Right to withdraw consent, where provided and at any time. Revocation of consent does not affect the lawfulness of the processing based on the consent given before revocation; 

-Right to lodge a complaint with the supervisory authority. 

Additional rights of the data subject:

 - Right to object to and restrict processing carried out by means of profiling for the exclusive purposes referred to in point E), paragraph 2 of this notice pursuant to Article 22 GDPR.

It is mentioned that you, in your capacity as a data subject, have the right not to be subjected to a decision based solely on profiling (purposes referred to in point E), paragraph 2 of this notice), which significantly affects your person unless such processing is based on your explicit, unambiguous and unconditional consent, exercised in writing and separate from other specific requests for consent.

Furthermore, in the event of the provision of explicit, unambiguous and unconditional consent exercised in writing to the aforementioned profiling processing (purposes referred to in point E), paragraph 2 of this notice), the data controller shall implement appropriate measures to protect the rights, freedoms and legitimate interests of the data subject, at least the right to obtain human intervention by the data controller, to express your opinion and to contest the decision, including in the event that the data controller should eventually become aware of data referred to in Article 9 GDPR (special data)

-Limitations to the obligations of data controllers and data processors under Art. 23 GDPR

The obligations on data controllers and processors to make this disclosure pursuant to Art. 12 GDPR, not to submit to automated procedures pursuant to Art. 22 GDPR, and to make the disclosures pursuant to Art. 34 GDPR may be waived exclusively upon your consent or by necessity of disclosure to the Supervisory Authorities for reasons of national security, public safety, defense in court, for the prevention, detection and prosecution of crimes, for the protection of the interests and freedoms of others, for the independence of the judiciary, for the execution of civil actions, and for relevant objectives of public and economic interest.

-Right to withdraw consent: consent to data processing may be withdrawn at any time by the data subject.
